Election Commission Faces Row Over BJP Seal on Official Letter, Calls It ‘Clerical Error’

The Election Commission of India has come under scrutiny after an official communication bearing the seal of the Bharatiya Janata Party’s Kerala unit surfaced online, triggering a political controversy and sharp reactions from opposition parties.


The issue was first raised by the Communist Party of India (Marxist), which shared a copy of an affidavit attached to a letter originally issued in March 2019 to political parties. The document appeared to carry the BJP Kerala unit’s seal instead of that of the Election Commission, raising questions about procedural integrity.

Responding to the concerns, the Election Commission clarified that the incident was the result of a “purely clerical error” and had been corrected promptly. According to the Office of the Chief Electoral Officer (CEO) in Kerala, the mistake occurred due to an oversight during document handling.

The CEO’s office explained that the BJP’s Kerala unit had recently submitted a photocopy of a 2019 directive while seeking clarification on guidelines related to the disclosure of candidates’ criminal antecedents. The submitted copy already contained the party’s seal.

Due to an inadvertent lapse, officials failed to notice the seal and circulated the same document to other political stakeholders as part of the clarification process.

Upon identifying the error, the office issued a formal withdrawal notice on March 21 to all political parties, District Election Officers, and Returning Officers, retracting the incorrect document.

The Election Commission reiterated its commitment to maintaining a transparent and impartial electoral process, urging the public and media to avoid spreading misleading interpretations of the incident.

However, opposition parties strongly criticised the development. The CPI(M) questioned the independence of the poll body, suggesting that the overlap between a political party’s symbol and an official document reflects a deeper institutional concern.

Similarly, the Congress party’s Kerala unit raised pointed questions about how the party’s seal appeared on an official Election Commission document, calling for greater accountability and clarity.

Despite the clarification, the episode has intensified political debate around the functioning and perceived neutrality of constitutional institutions, especially in the context of electoral governance.
