New Delhi: Former Cricketer and Bharatiya Janata Party (BJP) MP Gautam Gambhir has been summoned by the Karkardooma Court in Delhi on Monday in a case filed in connection with the alleged construction of an unauthorized library on Municipal Corporation of Delhi (MCD) land in Priya Enclave.
The petitioners have alleged that the land was earmarked for a dumping yard, news agency ANI reports.
According to the report, Additional Senior Civil Judge Himanshu Raman Singh of Karkardooma Court had on Monday summoned Gautam Gambhir on December 13, 2022. Petitioner Advocate Ravi Bhargava and Rohit Kumar Mahiya have filed a civil suit against the former Indian cricketer and the MCD.
The petitioners have sought an order from the court to restrain Gambhir from using the alleged illegal construction of the library. The petitioners argued in the court that the trial could be treated under Section 91 of the CPC. On the petitioners’ plea, the court issued summons to the respondent.
According to the report of ANI, it has been alleged in the lawsuit that Gambhir has unauthorizedly constructed the library on the said land with the connivance of higher officials of MCD. This land was earlier being used for a dumping yard. It is alleged that first, the MCD officials got 300 square yards vacated, then the BJP MP allegedly occupied it without any valid permission.
The petition also referred to a complaint/letter sent by BJP MLA Anil Bajpai to the Lieutenant Governor. The petitioners have also referred to an article published on October 7, 2022 in an English daily. In this, Gambhir had reportedly said that he had not taken permission from any authority to construct the library.
The petitioners have sought a direction from the court to the MCD to take back the possession of the land. Along with this, instructions have been given to demolish the illegal construction.
