The fatal Shastri Nagar accident, in which a speeding Mercedes driven under the influence claimed the life of biker Debiprasad Routray, has now been booked under multiple stringent provisions of the Bharatiya Nyaya Sanhita (BNS) and the Motor Vehicles Act (MV Act).
Police registered the case based on the complaint filed by the victim’s wife, applying BNS Sections 281, 105, 106(1) and MV Act Section 185.
- BNS 281 covers rash or negligent driving endangering human life, punishable with up to six months’ imprisonment, a fine of Rs 1,000, or both.
- BNS 105 applies when death is caused with knowledge or intent that the act could be fatal, carrying punishment of life imprisonment or 5–10 years in jail plus fine.
- BNS 106(1) deals with death caused by negligence without intent, punishable with up to five years’ imprisonment and fine.
- MV Act Section 185 penalises drunk driving, with up to six months’ jail or Rs 10,000 fine for first offence, and up to two years’ jail or Rs 15,000 fine plus licence cancellation for repeat offences.
Legal experts note that bail is relatively easier under Sections 281 and 106(1), often within a week, but tougher under Section 105 and MV Act 185, depending on severity and prior record.
