The Supreme Court on Thursday directed the Delhi Police not to take any coercive action against an independent journalist who alleged she was sexually assaulted by an Assistant Commissioner of Police (ACP) during recent demonstrations at Jantar Mantar.

A bench comprising Chief Justice of India Surya Kant and Justice Joymalya Bagchi termed the allegations against ACP Vivek Bhagat serious, noting that the court is evaluating whether an independent investigation is required.

The Delhi Police Crime Branch is investigating her complaint, while a counter-FIR was registered against her under the SC/ST Act on a complaint by Bhagat alleging public humiliation, defamation, and casteist remarks.

Representing the government, Solicitor General Tushar Mehta assured the bench that the matter would be examined and findings submitted before the apex court. He stated that the journalist would not be arrested provided she cooperates with the probe, while pointing out difficulties in distinguishing accredited press from “reel-makers” on social media.

Ordering a timebound inquiry into the journalist’s complaint, the top court acknowledged the need to examine systemic safeguards. The bench observed that while certain categories of journalists might require extra layers of protection, guidelines are needed to prevent misuse of press credentials.

The order follows the Delhi High Court’s refusal earlier in the day to grant an urgent hearing on her protection plea.
