Arvind Kejriwal Seeks Delhi High Court Judge’s Recusal, Files Fresh Affidavit Alleging Conflict of Interest

Arvind Kejriwal, former Chief Minister of Delhi, has filed an additional affidavit in the Delhi High Court seeking the recusal of Justice Swarana Kanta Sharma from hearing the CBI’s appeal in the excise policy case.


Allegations of Conflict of Interest

In his affidavit, Kejriwal raised concerns about a possible conflict of interest, stating that:

  • The judge’s son and daughter are empanelled as legal counsels for the Centre
  • They are assigned cases by Tushar Mehta
  • The same Solicitor General is representing the Central Bureau of Investigation (CBI) in this case

Kejriwal argued that this creates a “direct and serious apprehension of bias”.

The affidavit highlighted that:

  • The judge’s son handled thousands of government cases over recent years
  • Both children continue to receive government assignments
  • The same legal ecosystem is involved in the ongoing case

According to Kejriwal, this overlap raises questions about impartiality in the proceedings.


Concerns Over Court Proceedings

Arvind Kejriwal also expressed concerns about:

  • Not being given adequate opportunity to present rebuttal arguments
  • Hearings continuing beyond court hours
  • Orders being passed in the main case while the recusal plea was still pending

He stated that such actions intensified his apprehensions about fairness.

  • A trial court had earlier discharged Kejriwal, Manish Sisodia, and others, citing lack of prima facie evidence
  • The Central Bureau of Investigation challenged this decision in the High Court
