Sundargarh: The pension and gratuity in full of a retired Head Clerk in Sundargarh district were withheld permanently after his conviction in a bribery case.
The accused has been identified as Md. Sabir Hussain, Ex-Head Clerk (Retired), O/o Tahasildar,
Balisankara Tahasil, Dist-Sundargarh.
Hussain was charge-sheeted by Odisha Vigilance in Sambalpur Vigilance PS Case No.44 dtd.13.05.2015 U/s 13(2) r/w 13(1)(d)/7 PC Act, 1988 for demanding and accepting a bribe from a complainant for processing
a mutation case regarding the transfer of ownership of land was imposed with the penalty of withholding of pension & gratuity in full permanently as per provision of Rule 7 of the OCS (Pension) Rules,1992 with effect from 16.05.2024 by the competent authority following his conviction by the Special Judge, Vigilance, Sundargarh in a bribery case.
Hussain was convicted by Special Judge, Vigilance, Sundargarh on 18.11.2023 and sentenced to undergo rigorous imprisonment for a period of 4 years and a fine of Rs.2,000 and in default of payment of fine, to
undergo further rigorous imprisonment for a period of 2 months more for the offence U/s 13(2) r/w 13(1)(d) of the PC Act, 1988. The court had further sentenced him to undergo rigorous imprisonment for 3 years and payment of a fine of Rs.2,000/- and in default of payment of the fine, to undergo further rigorous imprisonment for 2 months more for the offence U/s 7 PC Act,1988.
Following the conviction of Md. Sabir Hussain Odisha Vigilance had communicated in this regard to the competent authority to take appropriate action against Md. Sabir Hussain.
Accordingly, Hussain was imposed with a penalty of withholding of pension & gratuity in full permanently by the competent authority for bribery.
