Important Laws Every Woman In India Should Know About

According to data released by the National Crime Records Bureau, lakhs of crimes against women are reported every year across the country, including domestic violence, harassment, assault, and cyber-related offences.

Understanding legal rights can help women protect themselves, seek justice, and access institutional support when needed. Here are some of the most important laws and legal protections every woman in India should know about.

Safety And Protection Laws For Women

India has several criminal laws designed to protect women from violence, harassment, and abuse.

Right To Zero FIR

A woman can file an FIR at any police station, irrespective of where the incident took place. This provision helps ensure immediate legal action without jurisdiction-related delays.

IPC Section 354

Indian Penal Code Section 354 protects women against assault or use of criminal force intended to outrage modesty.

IPC Section 354A

This section deals with sexual harassment, including unwelcome physical contact, inappropriate advances, or demands for sexual favours.

IPC Section 354B

This law addresses assault or criminal force used with the intention of disrobing a woman.

IPC Section 354C

This section criminalises voyeurism, including secretly watching or recording women without consent.

IPC Section 354D

This law covers stalking, both online and offline, including repeated unwanted communication or surveillance.

Domestic And Relationship Rights

Several laws in India aim to protect women within marriages and domestic relationships.

Protection Of Women From Domestic Violence Act, 2005

Protection of Women from Domestic Violence Act, 2005 provides protection against physical, emotional, verbal, sexual, and economic abuse within households.

Dowry Prohibition Act, 1961

The law makes giving or receiving dowry a punishable offence in India.

IPC Section 498A

This section protects married women against cruelty and harassment by husbands or relatives.

Right To Maintenance

Under Code of Criminal Procedure Section 125, women can seek financial maintenance from their spouse if neglected or abandoned.

Workplace Rights Every Woman Should Know

Women employees in India are protected by workplace safety and equality laws.

POSH Act, 2013

Sexual Harassment of Women at Workplace Act, 2013 safeguards women against workplace harassment and requires organisations to establish Internal Complaints Committees.

Maternity Benefit Act, 1961

This law provides paid maternity leave, employment protection, and maternity-related benefits for eligible women employees.

Equal Pay Rights

Under the Equal Remuneration Act, 1976, women are entitled to equal wages for equal work without gender-based discrimination.

Child Protection Laws In India

India also has strong legal safeguards aimed at protecting minors.

POCSO Act, 2012

Protection of Children from Sexual Offences Act, 2012 protects children from sexual abuse, harassment, and exploitation.

Child Marriage Prohibition Act, 2006

Women in India also have legal rights related to marriage, divorce, and property ownership.

Right To Free Consent In Marriage

Forced marriage is illegal under Indian law, and valid consent from both individuals is mandatory.

Right To Divorce

Women can seek divorce under various personal laws applicable in India, including Hindu, Muslim, Christian, and Special Marriage laws.

Right To Streedhan

A married woman has full ownership rights over gifts, jewellery, money, and valuables received before, during, or after marriage.

Indian law also guarantees several constitutional and legal protections for women.

Right To Privacy

The landmark Justice K.S. Puttaswamy vs Union of India judgment recognised privacy as a fundamental right under the Constitution.

Right To Free Legal Aid

Under the Legal Services Authorities Act, eligible women can access free legal aid and legal representation.
