All India Students’ Association (AISA) president Neha Bora moved the Delhi High Court on Thursday to challenge a Delhi Police notice directing her to execute a Rs 10,000 personal bond following her detention during a protest.
Appearing for Bora, Senior Advocate Gopal Sankaranarayanan termed her 12-hour detention and the subsequent notice issued by the Special Executive Magistrate “completely illegal.” He clarified to the court that Bora was executing her own planned flag march at Mandi House on October 16 and was not involved in a separate protest call issued by the Cockroach Janta Party (CJP) at Connaught Place’s Central Park.
The Delhi Police notice issued on October 17 cited three grounds for requiring the bond: alleged sloganeering at Mandi House, repeated protests near Jantar Mantar despite prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), and alleged instigation of the CJP protest.
In her petition filed through advocate Abhik Chimni, the student leader asserted that the notice was factually incorrect, ambiguous, and in violation of Articles 19 and 21 of the Constitution.
The plea further highlighted that the authorities failed to substantiate any genuine likelihood of a breach of peace or specify the period for which the bond was required.
