Opposition Files Fresh Motion to Remove CEC Gyanesh Kumar

Opposition parties have filed a fresh motion in the Rajya Sabha seeking the removal of Chief Election Commissioner Gyanesh Kumar.


The notice, signed by 73 MPs from 11 parties, accuses Kumar of nine counts of proven misbehaviour and partisan conduct during the recent election processes.

Congress MP Jairam Ramesh confirmed the submission on April 24, stating that the motion alleges Kumar acted at the behest of top government leaders. This marks the second attempt to remove him after a similar notice in March was rejected.

Opposition leaders claim Kumar favoured the ruling BJP by mishandling the Special Intensive Revision of electoral rolls and obstructing probes into alleged electoral fraud. They also accuse him of defying Supreme Court directions, enabling voter disenfranchisement, and issuing politically biased notices—such as the 24-hour show-cause notice to Congress president Mallikarjun Kharge while ignoring complaints against Prime Minister Narendra Modi and Home Minister Amit Shah.

Under Article 324(5) of the Constitution, removing a CEC requires the same process as for a Supreme Court judge, demanding a special parliamentary majority. The Judges (Inquiry) Act, 1968 stipulates that both Houses must admit the motion before an inquiry committee is formed.
