Odisha Issues Strict Directives Against Unauthorized Constructions Following Supreme Court Ruling

To curb unauthorized constructions, the Odisha Housing and Urban Development (H&UD) Department has issued strict directives to all development authorities and local bodies across the state.


The order follows a Supreme Court ruling that called for decisive action against buildings constructed without approved plans or planning permission.

As per the notification, builders must now submit an undertaking that possession of any property will only be handed over after obtaining a valid completion or occupation certificate. Approved building plans must be displayed prominently at construction sites, and service connections—such as electricity, water, and sewerage—will be granted only after submission of these certificates.

The government has also instructed banks and financial institutions to approve loans only after verifying valid completion certificates. Business and trade licenses will be denied to unauthorized structures, whether residential or commercial.

Authorities have been directed to conduct regular inspections, maintain official records, and take immediate legal action against violations. Officials found issuing wrongful certificates may face penalties. Pending appeals related to unauthorized constructions must be resolved within 90 days.

The directive emphasizes that illegal constructions not only endanger lives but also strain civic infrastructure and disrupt urban planning. The government has called for full cooperation from all departments to ensure enforcement and protect public interest.
