Elon Musk’s X Corp, formerly known as Twitter, has filed a writ petition under Article 226 in the Karnataka High Court, challenging what it calls “arbitrary censorship” by the Indian government.


The legal dispute centres on the interpretation of Section 79(3)(b) of the Information Technology Act and the bypassing of established safeguards outlined under Section 69A.

In its plea, X Corp has argued against the Sahyog Portal—a digital platform managed by the Ministry of Home Affairs for expedited content takedown orders—alleging that it creates a parallel framework for censorship without transparency.

The company is seeking declarations to invalidate multiple government directives, reaffirm existing legal safeguards, and ensure that Section 69A remains the sole statutory mechanism for content regulation.

This high-profile case raises significant questions about the balance between government oversight and online freedom of expression.

The next court hearing is set for March 27, and the outcome may redefine the future of internet governance in India.
