In a significant verdict emphasising the commitment to justice, the Court of Additional Sessions Judge II in Khurda district has convicted and sentenced Banka Nayak, a resident of Tangiapada, to 10 years of rigorous imprisonment in a rape case.
The case (ST Case No. 79/224) stems from a gruesome incident that occurred on the night of February 6/7, 2024, in a village under the Jankia Police Station limits. According to the prosecution, around 1 AM, the accused took advantage of the victim’s husband being away from home. He unlawfully entered the house where the woman was sleeping alongside her blind son and minor daughter. The accused assaulted the sleeping victim, committing rape.
When the victim’s son attempted to intervene, the accused slapped him and threatened to kill him before fleeing the scene.
After a thorough investigation, review of statements from both sides, evidence, and scientific proofs, the court found Banka Nayak guilty on multiple charges under the Indian Penal Code (IPC).
– Under Section 376(1) IPC (rape): 10 years rigorous imprisonment and a fine of ₹20,000 (in default, additional 3 months imprisonment).
– Under Section 450 IPC (house trespass): 5 years imprisonment and a fine of ₹5,000 (in default, additional 2 months imprisonment).
– Under Sections 506 (criminal intimidation) and 323 (voluntarily causing hurt): 2 years and 6 months rigorous imprisonment.
The investigation was led by the former IIC of Jankia Police Station, Gayatri Mishra. The prosecution was efficiently handled by Additional Public Prosecutor Rudraneel Bhattacharya under the supervision of Khurda Deputy Director of Prosecution, Nalinikant Maharana.
