In a firm diplomatic response, India pushed back against statements by United Nations human rights experts, asserting that human rights mechanisms must not be weaponized as instruments of political pressure or selective country targeting.

The statement, delivered at the UN General Assembly’s Third Committee in New York on Tuesday, came after more than 20 UN experts in Geneva expressed concern regarding law enforcement responses to youth-led demonstrations in New Delhi.

India’s Statement at the UN General Assembly

Speaking during a session on the Working Group on Enforced Disappearances, Barkha Tamrakar, Deputy Secretary in the Ministry of External Affairs, emphasized India’s constitutional checks and balances and institutional safeguards.

  • Principles of Engagement: Tamrakar noted that while India engages with international bodies, such interactions must be guided by dialogue, consultation, non-selectivity, and transparency.
  • Rejection of Unverified Claims: India firmly opposed attempts to convert “unverified allegations, incomplete statistics, or reports without India country observations into a negative characterisation of the world’s largest democracy.”
  • Rule of Law: Describing India as a vibrant democracy governed by constitutional guarantees, Tamrakar reiterated the country’s commitment to preventive measures, accountability, and civil society protection, pointing to India’s status as a signatory to the International Convention for the Protection of All Persons from Enforced Disappearances.

Context Behind the UN Experts’ Remarks

The commentary from UN human rights rapporteurs in Geneva follows weeks of youth and student-led demonstrations in the national capital:

  • Background of Protests: Protests led by groups including the Cockroach Janta Party (CJP) and various student unions have focused on the Election Commission of India’s (ECI) Special Intensive Revision (SIR) exercise.
  • Scale of Electoral Revision: The revision exercise impacts approximately 130 million (13 crore) citizens, with demonstrator grievances focusing on voter list updates.
  • UN Concerns: The Geneva panel urged Indian authorities to ensure peaceful assembly rights, raised questions regarding preventive detentions, and called for ongoing dialogue with civil society representatives.

In response, Indian diplomats maintained that domestic legal avenues and independent judicial oversight remain fully equipped to handle law and order matters while upholding fundamental rights.
