In a significant relief to a homebuyer, the Adjudicating Officer of the Odisha Real Estate Regulatory Authority (ORERA) has directed M/s Mahavir Metropolis Pvt. Ltd. to pay ₹22 lakh as compensation to complainant Sri Ananta Narayan Acharya for prolonged delay, non-completion of the project, and failure to hand over possession of flats in the “Mahaveer Mansion” project at Gopalpur-on-Sea, Ganjam district.
Passing the order in AOCC Case No. 55/2024, the Authority held that despite execution of a registered sale deed in 2017 and receipt of the entire consideration amount of ₹22.80 lakh, the developer failed to complete the flats and deliver possession even after more than eight years.
Rejecting the developer’s claim of pending dues, the Adjudicating Officer observed that the sale deed itself clearly acknowledges full payment and that the plea of outstanding amount was an afterthought, unsupported by any documentary evidence.
The Authority further ruled that the project qualifies as an ongoing project under the RERA Act, as essential amenities such as lift, transformer, fire-fighting system, and basic internal fittings were not provided, and possession was never handed over.
Considering the financial loss, prolonged mental agony, and harassment suffered by the complainant, the Authority awarded ₹22,00,000 as compensation, directing the developer to pay the amount within 45 days. In case of default, the amount will attract interest at 9.70% per annum until full realization. The complainant has also been granted liberty to initiate recovery proceedings under Section 40 of the RERA Act.
The order was pronounced on 13 November 2025 by the Adjudicating Officer, ORERA, Bhubaneswar.
