New Delhi: In a landmark decision the apex court on Tuesday said that daughters will have right over parental property.
The ruling said that it will be applicable even if the coparcener had died prior to the date the Hindu Succession (Amendment) Act, 2005 came into being.
A three-judge bench of the highest court of the land delivered the significant ruling. The pronouncement came during the hearing that related to the appeals if the Hindu Succession (Amendment) Act, 2005, had a retrospective effect.
Justice Arun Mishra was quoted by media as saying that daughters must be given equal right as sons. He said daughters remain as loving daughters throughout life and added that they shall remain coparcener throughout life irrespective of their fathers are alive or not.
