On observation of the fact over disputed land, Bhubaneswar Municipal Corporation (BMC) has issued a letter to stop construction of the “Urban Majestic Apartment” in Patia.
The permission for a building plan of the same plot was issued by BMC for the construction of a multistoried apartment building over plot no. 309/1694, Khata no.474/5 under mouza Patia in favour of M/s “Paltronics Allied Industries Pvt. Ltd” on 02-01-2024. However, based on a letter from the GA & PG Department Govt. of Odisha; Commissioner BMC has ordered to stop construction on the same land.
On the other hand, the GA & PG Department has directed Tahsildar Bhubaneswar to correct the ROR in Pattadar status by deleting Sthitiban. Pertinent to mention that, the same land was a case of lease deed and there has been illegal conversion of kisam as depicted in the letter from the GA & PG Department. Going by the instructions furnished in the said letter Commissioner BMC has taken immediate steps instructing the planning section to cancel the planning approval till further decision by the competent authority.
As stated in the planning guideline; “In case of any dispute arising out of land record or in respect, title, interest after the permission is granted, the permission so granted shall be treated as automatically cancelled during the period of dispute”. A disputed land cannot be allowed for construction when it comes to the notice; told Commissioner Sri Rajesh Prabhakar Patil.
On the issue of the letter to the said agency; it has stopped construction and BMC is vigilant on it. Any case of disobedience to the letter issued to the agency will be viewed seriously and BMC will seal the venue / deploy enforcement if the situation demands. The said construction was on 5 acres of land and six nos. of apartment blocks were under construction.
