Lucknow: Reinforcing Centre’s stance on ‘Triple Talaq’ the Allahabad High Court on Thursday termed it as unconstitutional, cruel and a monstrosity.
In a strong observation on the issue Justice Suneet Kumar said Muslim law as applied in India has taken a path quite opposite to the rules of Holy Quran. It violates a wife’s right to divorce, the court said.
Individual laws of any community cannot claim supremacy over rights granted by constitution, Allahabad High court said adding that since the country’s apex court is hearing on the issue it will not say anything more about that.
During October last month the government told the SC that triple talaq violates the fundamental rights guaranteed by the constitution. Those who do it are instigating people. In the country lives of women cannot be allowed to be ruined by any such laws, the government had said.
Meanwhile, all India personal Muslim board has strongly opposed any court’s intervention in the matter saying that sharia laws cannot be modified by any court.
