Bhubaneswar/Kolkata: In yet another setback for Chhattisgarh, the Calcutta High Court today asked the state government to withdraw the writ petition challenging National Green Tribunal (NGT)’s order to stop construction of 31 projects led by it on the upstream of Mahanadi River.
A Bench of the High Court comprising of acting Chief Justice Nishita Mhatre and Justice Tapabrata Chakraborty ordered the Chhattisgarh government to withdraw the petition failing which the court will pass an order of non-maintainability. The court adjourned the hearing over the matter till November 2 on request of Chhattisgarh.
The High Court Bench held that the petition against any order of NGT is not maintainable before it under Section 22 of National Green Tribunal Act, 2010.
Earlier, on July 26, the NGT had issued stay order on 31 projects led by Chhattisgarh while hearing the petition filed by social activist Sudarsan Das.
